If you purchase any products via this website, you must agree to these Terms of Trade as well as the Terms of Use.

This document explains the terms for buying products from the S A L T B U S H & C L A Y Australia online store, operated by S A L T B U S H & C L A Y. Please read these terms before making a purchase, as they include important information about warranties and limitations of liability.

In these terms, “you” refers to the person or organization ordering products from the website, “website” means www.saltbushandclay.com, and “Products” refers to items sold by S A L T B U S H & C L A Y. These terms apply to any purchase made through the website or the Click & Collect service for delivery in Australia, where orders can be picked up in Imbil and Bondi. By placing an order, you agree to these terms, and each order you make is a separate contract with Hinterland Living.

Shipping costs and deliveries

We strive to deliver products to your requested location within the timeline we provide when you place your order, but we cannot guarantee exact delivery dates or times. Delivery options and information are estimates only. To the fullest extent allowed by law, Hinterland Living is not responsible for any loss you or others may experience due to delivery delays for any reason.

Orders

To order Products from S A L T B U S H & C L A Y, you must: (a) create an account on our website by providing your information and setting up a username and password; or (b) fill out the required details on the checkout page; and (c) complete your online order. If you want to cancel or change an Order, please reach out to us. We might be able to help if the Order hasn’t been processed yet, but we can't promise it. S A L T B U S H & C L A Y can refuse any Order and will inform you promptly while issuing a full refund if that happens. If a Product is out of stock after you submit your Order and payment, we will either refund or exchange it. You agree that all ordered Products are for personal use or gifting only and cannot be resold anywhere. S A L T B U S H & C L A Y may take legal action against unauthorized sales.

Prices and Payment

All prices on the website are in Australian dollars and include GST. Prices can change without notice. Please confirm prices when placing your Order. The total amount you owe Hinterland Living will include: (a) the price of each Product and applicable taxes listed on the website when you place your Order; (b) delivery costs for your chosen option, as mentioned in the shipping section; and (c) any additional fees that may apply, which you consented to when providing your agreement (like subscription fees). You must pay the total amount using an accepted payment method at the time of your Order. Accepted payment methods are listed on the website. Hinterland Living can change payment options at any time.

Title and Risk

Title to and the associated risk of loss or damage to the carefully crafted Products is transferred from S A L T B U S H & C L A Y to you at the precise moment of the delivery of the Products to your specified address.

Liability

If you do not pay according to these Terms, S A L T B U S H & C L A Y can choose to take actions like withholding or disposing of your order or refusing to continue business with you. S A L T B U S H & C L A Y is not responsible for any loss or damage that results from these actions. You are responsible for deciding if the Products suit your needs. If you experience loss or damage because of S A L T B U S H & C L A Y not meeting its obligations, our liability is limited to a refund or replacement of the Products. We will not be liable for special or indirect damages related to any Products sold.

No Warranty

S A L T B U S H & C L A Y does not guarantee or take responsibility for the Products’ condition, quality, or fitness for use, or for any website content. We are not liable for any loss or damage from Product faults or website errors.

The Products have guarantees under Australian Consumer Law, allowing you to request a replacement or refund for major issues, and compensation for other foreseeable losses. You can also have Products repaired or replaced if they aren't of acceptable quality and the issue isn't major. Additionally, you may have the right to take action against Hinterland Living for any defective Products that cause injury or loss.

Refunds and Returns

If you would like to return or exchange a Product that you have purchased from us, please do not hesitate to contact us directly. Our dedicated team is here to assist you with any concerns you may have regarding your order.

Force Majeure

If Hinterland Living is unable to fulfill any of its obligations due to events outside its control, it will not be liable for any non-performance, and the deadline will be extended until the issue is resolved.

GST

In this clause: (a) terms defined in the A New Tax System (Goods and Services Tax) Act 1999 (Cth) (GST Act) will have the same meaning here; and (b) any mention of a party includes its representative in a GST group. Unless stated otherwise, all payments under these Terms of Trade do not include GST. If GST is due on any supply, the recipient must pay the supplier an extra amount equal to the GST at the same time as the payment for the supply. Clause 3 does not apply if: (a) the payment includes GST; or (b) the recipient pays GST under a reverse charge. The recipient only needs to pay the GST Amount after receiving a tax invoice or adjustment note. If there is a change related to a supply, the GST Amount must be adjusted accordingly, and a payment must be made between the supplier and recipient as needed. If these Terms require a calculation based on another amount (Reference Amount) for a taxable supply or creditable acquisition, exclude any GST from that Reference Amount. If a party needs to reimburse another for a cost or expense, reduce the amount by any input tax credit the reimbursed party can claim for that cost or expense.

Hinterland Living Digital Gift Cards

A S A L T B U S H & C L A Y Digital Gift Card allows the holder to buy products worth the card's value at the S A L T B U S H & C L A Y online store in Australia. This applies only to gift cards bought from the Australian store. The card's value can be used in full or part for multiple purchases but cannot be reloaded, exchanged for cash (unless required by law), or transferred to another card. Gift cards are valid for 36 months from the purchase date. After expiration, the card has no value. To check the balance, visit the Australian S A L T B U S H & C L A Y online store. Each card has a unique number and PIN for security and multiple transactions.

General

If any part of these Terms of Trade is ruled invalid by a court, that part will be removed, but the rest will stay in effect. The parties will try to agree on a replacement term. These Terms of Trade, along with your Order (accepted by S A L T B U S H & C L A Y), Terms of Use, Returns Policy, and Privacy Policy, form the complete agreement between the parties and replace any prior agreements. Orders and these Terms will follow the laws of Queensland, Australia, and the parties agree to the courts of Queensland for any related disputes. S A L T B U S H & C L A Y can change these Terms at any time. Changes will take effect when the updated Terms are posted online. The Terms that apply when you place an Order are the ones that govern that Order. These Terms were last updated on 30 January 2025.
